ARTICLE 1 – PREAMBLE

Scope of the agreement: These contractual provisions govern any acquisition of products made on the AWEIO online platform managed by AWEIO, registered in the register of legal persons under number 0799.545.264 (VAT BE 0799.545.264), with its registered office at 22B Chemin de bois de Rechain 4800 Verviers (Belgium). Logistics management is centralized at the same address.

The purchase of any product displayed on the AWEIO website implies full acceptance of these contractual clauses, as well as of our privacy policy.

Consequently, the customer acknowledges that he/she is fully aware of the fact that his/her consent to the provisions of these contractual conditions does not require the formality of a handwritten signature, insofar as the customer wishes to place an online order for the products displayed in the website’s virtual boutique.

ARTICLE 2 – GENERAL CONDITIONS

2.1 General information

AWEIO may archive or update these terms and conditions. It is important to note that the maintenance and updating of this document is the sole responsibility of AWEIO.

AWEIO reserves the right to modify these terms and conditions of sale at any time, provided that such modifications are posted on its website. We therefore recommend that you regularly consult the latest version of the general terms and conditions of sale, which are always available on the site.

2.2 Definitions

The term “INDIVIDUAL USER” includes any natural or legal person who acquires or uses, for purposes strictly unrelated to a professional activity, products or services presented on the website. As a private user, the customer benefits from specific rights, which may be called into question if the products or services acquired through the website are in fact related to his professional activity.

The term “PROFESSIONAL USER” refers to any person who does not meet the above definition of an individual user.

ARTICLE 3 – CONCLUSION OF THE ONLINE SALE

The list of items and their descriptions on www.aweio.com is not a formal offer. Thus, the mere submission of an order form on the above-mentioned site is not sufficient to establish a sales contract. The transaction will not be finalized until the confirmation email has been received.

In the interests of security and customer guarantee, Aweio reserves the right to request additional information and to refuse to execute the order in the absence of an appropriate response, or if Aweio considers that the information at its disposal is insufficient. Aweio may also reject orders where the buyer appears to intend to resell the products.

ARTICLE 4 – ORDER CONFIRMATION

Contractual details will be confirmed electronically at the latest on receipt of delivery.

ARTICLE 5 – PURCHASING

Aweio will process your order while stocks last or subject to availability from its suppliers. Shipping times vary from 2 to 3 working days for Belgium, from 2 to 5 working days for France, and from 5 to 10 working days for Luxembourg, Germany, and the Netherlands, except in the case of exceptional circumstances such as adverse weather conditions, strikes, traffic problems, or congestion of transport services, etc. However, if despite all the precautions taken, the products become unavailable after your order, Aweio will inform you by e-mail and will propose to you to cancel or modify your order.

Please note that your order will be prepared the same day only if it is placed during the week (working days) and before noon. The delivery time starts as soon as the parcel leaves our warehouse (order status = “dispatched”), not when you confirm your order.

ARTICLE 6 – AVAILABILITY

Product availability is not displayed on our site. As a general rule, a product offered for sale is supposed to be available immediately. However, Aweio cannot be held responsible if stock levels have changed since the order date. Any unavailability is generally indicated on the website.

If Aweio is unable to obtain a product from its suppliers within a reasonable period of time (for example, if the supplier itself is out of stock), it will inform the customer of the expected delay by e-mail. The customer may then choose to cancel or modify the order on the basis of this new information. No cancellation penalty will be applied for such an order cancellation.

Aweio reserves the right to dispatch the order when the entire order is available for dispatch.

ARTICLE 7 – TRANSFER OF OWNERSHIP

As an exception to article 1583 of the French Civil Code, the exclusive ownership of the goods sold or delivered remains with Aweio until full payment of the order.

In accordance with article VI. 44 of the Code of Economic Law (CDE), goods are shipped at the company’s risk, unless transport is provided by a carrier chosen by the consumer and this option has not been suggested by the company.

For contracts stipulating that the company ships the goods to the consumer, the risk of loss and damage is transferred to the consumer in the following circumstances:

Upon delivery of the goods to the carrier not proposed by the company, without the consumer waiving the rights granted to him in respect of the carrier;

When the consumer or a third party designated by the consumer, other than the carrier, takes physical possession of the goods.

ARTICLE 8 – PRICES

The prices of our products are expressed in euros, all taxes included, excluding shipping costs. Delivery and shipping costs are at the customer’s expense, unless otherwise specified on the site. These costs are calculated taking into account the information provided by the customer concerning the place of delivery.

Aweio reserves the right to modify its prices at any time. However, Aweio is committed to respecting the prices in force, which will have been communicated to you at the time of your order, except in the case of a sale at a loss resulting from a technical problem beyond our control.

ARTICLE 9 – PAYMENT

Our payment systems are centralized and secured by our financial transaction partners, i.e. Paypal, Stripe or relevant banking entities. This guarantees the security of your information at all times and the reliability of your transactions.

Full payment is required when placing your order.

At no time will the sums paid be considered as deposits. All transactions are carried out in euros. You can use the following payment methods to pay for your order:

Payment by Bancontact (QR code): make a payment in a single gesture from your banking application by scanning the QR code displayed on the platform.

Payment methods for deliveries in Belgium :

  • Payment by credit card (Visa/Mastercard)
  • Payment by bank transfer
  • Payment by Paypal

 

In the case of bank transfers, products are reserved for the customer for a period of 5 working days from the order date, pending payment. After this period, we reserve the right to cancel the order.

By registering your order, you certify that you have all the necessary authorizations to use the selected method of payment. Aweio reserves the right to suspend or cancel any order and/or delivery in the event of non-payment (or payment incident) of any sum due. Delivery of a new order may be suspended in the event of late payment for a previous order, irrespective of the provisions herein. For all credit card payments, Aweio reserves the right to request a copy of your identity card and/or proof of payment.

ARTICLE 10 – DELIVERY

10.1 – General information

Products purchased on Aweio are shipped exclusively to the countries mentioned on the site, and will be delivered to the address specified on the order form. The lead times mentioned on the product sheet are approximate and include both shipment processing and transit times.

Aweio cannot be held responsible for the consequences of a delay in delivery attributable to the postal services. No refund of the order will be made until the products have been returned to the sender or have been delivered to the recipient with a delay.

In the case of payment by bank transfer, the order will not be processed until payment has been received. Consequently, the applicable deadlines in this case are those on the day of receipt of payment, which may differ from those mentioned at the time of ordering.

If you choose to cancel your order after payment and delivery has already been initiated, Aweio will only refund the product if it is received in perfect condition. We strongly recommend that you return the product in its original condition.

10.2 – Transfer of risk

Ownership and responsibility for your items will be transferred upon receipt of the products.

10.3 – Customs duties

When you place an order for products to be delivered to a country other than Belgium, you are considered the authorized importer and are required to comply with the laws and regulations in force in the country where the goods are received.

You may be subject to import duties or taxes when the goods arrive in your country. You will be responsible for any additional costs incurred during customs clearance. Aweio has no control over these fees and has no knowledge of their amount. As customs policies vary from country to country, we recommend that you contact your local customs office for more detailed information.

10.4 – Delivery problems

Please inform Aweio as soon as possible if you have any comments about the product received (e.g. damaged, already opened, etc.) or any anomaly concerning the items included in the parcel (expired, missing, not conforming to the order, etc.). This will enable us to intervene by activating the legal guarantee or by initiating the process of handling problems linked to the transport of your order, depending on the specific situation.

It is imperative to notify the company of a defect within the legal deadline of 2 months from the discovery of the defect.

10.5 – Product conformity

Aweio undertakes to refund defective products or products that do not conform to your order. Please inform us by e-mail at info@aweio.com.

We encourage you to notify us of any defects as soon as possible, within the statutory period of 2 months from discovery.

If possible, please return non-conforming products to us in their original condition, accompanied by all the items supplied (accessories, packaging, instructions, etc.).

In all cases, you benefit from the legal warranty provisions relating to hidden defects.

10.6 – Return of parcels

IMPORTANT: If the customer is absent at the time of delivery and does not collect the package from the post office within 15 days, the package will be returned to Aweio. In this situation, Aweio will reship the package to the customer only after receiving the returned package (or obtaining a refund from the post office in the event of loss). Shipping costs for this second delivery will be invoiced to the customer, even if no delivery notice has been left by the post office.

ARTICLE 11 – WARRANTY

11.1 Products purchased on this site are guaranteed for a period of two years.

11.2 Consult the product documentation for detailed information on the manufacturer’s warranty. It is important to note that this warranty in no way affects the mandatory rights provided by current legislation.

11.3 If necessary, any warranty claim must be addressed either directly to the manufacturer or publisher in accordance with the warranty conditions associated with the products purchased, or to Aweio by e-mail (info@aweio.com), within a maximum period of 2 months from the discovery of a defect in the product.

ARTICLE 12 – RIGHT OF WITHDRAWAL

12.1 General information

In accordance with the provisions of Book VI of the Code of Economic Law (CDE), the consumer has the right to inform the seller of his decision to withdraw from the purchase, without incurring penalties and without having to provide a reason, within 14 working days from the day after delivery of the product.

If possible, please return the product(s) in undamaged condition and complete (including original packaging, accessories and instructions), avoiding affixing the shipping label directly to the packaging of the returned product(s). Use a suitable carton for shipping.

Consumers wishing to exercise their right of withdrawal must contact Aweio within 14 working days.

Pursuant to Article VI.49, paragraph 1 of the Code of Economic Law, the consumer must inform the company of his decision to withdraw from the contract before the expiration of the withdrawal period. To this end, the consumer may :

  • Use a sample withdrawal form.
  • Formulate another unequivocal declaration setting out its decision to withdraw from the contract.

In accordance with articles VI.45, 8° and VI.50 of the Code of Economic Law, Aweio will reimburse any payments received from the consumer who has exercised his right of withdrawal, including delivery costs, without undue delay and upon receipt of the returned goods.

12.2 No right of withdrawal

According to article VI.45, paragraph 1, point 11 of the Code of Economic Law, the right of withdrawal does not apply to :

  • Food products
  • Cosmetic products
  • Sealed goods which cannot be returned for health or hygiene reasons and which have been opened by the consumer after delivery.

ARTICLE 13 – PROOF OF TRANSACTION

Computerized records stored in Aweio’s computer systems, under reasonable security conditions, will be considered as proof of communications, orders and payments between the parties.

Purchase orders and invoices are archived on a reliable and durable medium that can be presented as proof.

ARTICLE 14 – LIMITATION OF LIABILITY

14.1 The images and descriptions of the products presented on this site are informative and non-contractual. Aweio declines all responsibility for any errors or omissions in the images or descriptions appearing on the site. Aweio assumes no responsibility for the validity of the content of data sheets and product descriptions provided by our partners or suppliers.

14.2 Without prejudice to the provisions of these general terms and conditions of sale, any claim concerning delivered products, non-delivery of products or otherwise may not exceed the total purchase price of the products giving rise to the claim. In no event shall Aweio be liable for any indirect, incidental or consequential damages whatsoever (even if such damages were known or could have been known to Aweio) arising in connection with its products, their use, sale or the website.

ARTICLE 15 – FORCE MAJEURE

15.1 Aweio will do its utmost to meet its commitments, but cannot be held responsible for delays or non-delivery resulting from force majeure. Force majeure encompasses several criteria: it presupposes an unforeseeable, irresistible event beyond the control of the parties, rendering performance of the obligation impossible.

15.2 In the event of delay, Aweio will endeavour to meet its obligations as soon as possible and reserves the right to distribute remaining stocks of products fairly among its customers.

ARTICLE 16 – DATA MANAGEMENT AND LEGITIMATE INTERESTS OF THE CONTROLLER

By placing your order, you consent to Aweio recording, processing and using the data collected from your order form. Some of this information may be passed on to companies responsible for delivering your products and managing our direct marketing.

Under no circumstances will we disclose your data to third parties who have no connection with our field of activity.

By placing your order and accepting our terms and conditions, you automatically consent to receive electronic communications from us for marketing purposes. You can of course unsubscribe from our newsletter at any time by clicking on the unsubscribe link at the bottom of the e-mail or by contacting our customer service department.

By placing an order on the Aweio site, you also agree to receive e-mail requests for consumer opinions that are solely related to your purchasing experience on our site and the quality of the products purchased. Shared ratings and comments are automatically displayed publicly on the Aweio website, subject to moderation. Only your first name and the date of your order will be published with your comment.

ARTICLE 17 – APPLICABLE LAW AND FORCE MAJEURE

Aweio will make every effort to resolve any disputes amicably. In the event of dissatisfaction with the resolution of the dispute and if you wish to have recourse to the competent courts, the following conditions shall prevail.

The contract is subject to Belgian law. Each party acknowledges the exclusive jurisdiction of the courts of Liège (Belgium) for any dispute.
